Terms of Service

1. Introduction

Welcome to Tipite ("we," "us," "our"), a digital ticketing platform operated as a partnership under the laws of Malawi. These Terms of Service ("Terms") govern your use of our website, mobile application, and services (collectively, the "Platform").

By accessing or using Tipite, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

2. Definitions

  • "Customer" means any individual purchasing tickets through the Platform
  • "Organizer" means any individual or entity posting events and selling tickets through the Platform
  • "Event" means any activity, gathering, trip, or service for which tickets are sold on the Platform
  • "Ticket" means the digital proof of purchase issued for an Event
  • "User" means any person using the Platform, including Customers and Organizers

3. Use of the Platform

3.1 Eligibility

You must be at least 18 years old to use Tipite. By using our Platform, you represent and warrant that you meet this age requirement.

3.2 Account Registration

Users may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Prohibited Uses

You may not use the Platform to:

  • Post fraudulent, misleading, or illegal events
  • Sell tickets for events you do not have authorization to organize
  • Engage in any activity that violates Malawian law
  • Interfere with or disrupt the Platform's operation
  • Create multiple accounts to circumvent restrictions

4. Event Organizers

4.1 Verification Requirements

Before posting events, Organizers must complete our verification process, which includes:

  • Providing a valid National ID
  • Submitting legal documents for their organization (if applicable)
  • Providing social media links for verification purposes

4.2 Organizer Responsibilities

Organizers are solely responsible for:

  • The accuracy of event information
  • Delivering the promised event or service
  • Complying with all applicable laws and regulations
  • Handling customer service issues related to their events
  • Providing refunds in accordance with these Terms

4.3 Account Suspension

We reserve the right to suspend or terminate Organizer accounts if we determine, in our sole discretion, that the Organizer has engaged in fraudulent activities or violated these Terms.

5. Ticket Sales and Purchases

5.1 Ticket Validity

Tickets are valid only for the specific event, date, and terms stated at the time of purchase. Each ticket can only be used once and must be scanned for entry.

5.2 Ticket Transfers

Tickets are transferable. If you transfer your ticket to another person, you remain responsible for ensuring the ticket is used in accordance with these Terms and event requirements.

5.3 Entry Requirements

Entry to events is subject to:

  • Valid ticket presentation and successful scanning
  • Compliance with event-specific requirements
  • Meeting age or other eligibility requirements set by the Organizer

You may be denied entry if your ticket is invalid, fraudulent, or if you fail to meet entry requirements.

6. Fees and Payments

6.1 Service Fees

Tipite charges a 7% service fee on all ticket purchases, comprising:

  • 3% PayChangu transaction fee
  • 4% Tipite platform fee

Organizers may choose to either:

  • Include this fee in the ticket price (customer pays the fee)
  • Absorb the fee themselves (organizer pays the fee)

6.2 Payment Processing

We use PayChangu to process all payments. Accepted payment methods include mobile money, bank transfers, and cards as supported by PayChangu.

6.3 Organizer Withdrawals

Organizers may withdraw funds 24 hours after their event's scheduled time through:

Immediate Withdrawal:

  • Fee: 1.5% + K700 (PayChangu fees)
  • Processing: Instant

Manual Withdrawal:

  • Fee: K700 only
  • Processing: Up to 24 hours

7. Refunds and Cancellations

7.1 Customer Refunds

Customers may receive refunds in the following circumstances:

  • Event cancellation by the Organizer
  • Voluntary cancellation by the Customer (subject to event-specific policies)

Refunds will be 95.5% of the original payment due to PayChangu transaction fees (3% purchase fee + 1.5% withdrawal fee).

7.2 Event Cancellations

If an Organizer cancels an event, affected Customers will be notified and offered refunds according to Section 7.1.

8. Limitation of Liability

8.1 Platform Disclaimers

Tipite serves as an intermediary platform connecting Customers with Organizers. We are not responsible for:

  • Event quality, safety, or fulfillment
  • Injuries or damages occurring at events
  • Transportation delays or issues
  • Organizer no-shows or event cancellations
  • The accuracy of event information provided by Organizers

8.2 Limitation of Damages

To the maximum extent permitted by Malawian law, Tipite's total liability for any claims arising from your use of the Platform shall not exceed the amount of fees paid by you to Tipite in the twelve (12) months preceding the claim.

8.3 Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or technical failures.

9. User Content and Data

9.1 Content Ownership

Users retain ownership of content they upload to the Platform but grant Tipite a license to use, display, and distribute such content for Platform operations.

9.2 Data Protection

We collect and process personal data in accordance with our Privacy Policy and applicable Malawian data protection laws.

10. Intellectual Property

The Tipite platform, including its software, design, and content, is protected by intellectual property laws. Users may not copy, modify, or distribute our intellectual property without written permission.

11. Termination

11.1 Termination by User

Users may terminate their accounts at any time by contacting us or through account settings.

11.2 Termination by Tipite

We may suspend or terminate user accounts for violations of these Terms, fraudulent activity, or other reasons we deem appropriate.

12. Dispute Resolution

12.1 Internal Resolution

We encourage users to first contact us directly to resolve any disputes or concerns.

12.2 Governing Law

These Terms are governed by the laws of Malawi. Any disputes shall be resolved in the courts of Malawi.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Users will be notified of material changes, and continued use of the Platform constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
